The contract between the customer and IndiRun is only concluded by IndiRun’s acceptance of the order. The customer’s order is placed via the Internet and is binding. IndiRun accepts the order by sending the customer an order confirmation by e-mail.

3. Delivery conditions
Normally goods are delivered from our warehouse in Winterthur, Switzerland. The customer will usually receive the goods within 4-5 working days. I will always strive to meet the delivery deadlines specified by me. However, if disruptions in business operations occur for which I or my supplier are not responsible, in particular work stoppages, lockdowns as well as cases of unforeseeable event/s for which I am not responsible, the delivery time shall be extended accordingly. Any delays in delivery shall not entitle the customer to cancel the order or to claim compensation. The delivery is considered fulfilled when the goods leave my warehouse.
If I do not have the item in stock, I will inform you accordingly and send you the goods, immediately after receipt. The delivery will be made by mail (Post). Deliveries will only be made to Switzerland. I reserve the right to insist on payment in advance.

If you are in default with your payments, I am entitled to charge 5% interest on arrears in addition to the reminder costs. If I still see no reaction, I will take legal action.

In case of unjustified refusal to accept the ordered and delivered goods, I will charge the costs incurred by me. I will then try to contact you to clarify the situation. In case of repeated refusal of acceptance, subsequent orders will be refused.

We try to keep your data as safe as possible and do not pass the data to any third parties. The customer agrees to the collection, processing and use of his/ her personal data in accordance with the aforementioned instructions. 12. Severability clause
Should any clause of these General Terms and Conditions be invalid, this shall not affect the validity of the other clauses. If a clause of these General Terms and Conditions is invalid in only one part, the other part shall remain valid. The contracting parties shall be obliged to replace an invalid clause by a valid substitute provision which comes as close as possible to the economic purpose of the invalid contractual provision.

The entire legal relationship between IndiRun, Indranil Bhattacharya, Langgasse 63, 8400 Winterthur, Switzerland and the customer is governed by Swiss law.
14. Jurisdiction
These General Terms and Conditions are subject to Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.
Should any clause of these General Terms and Conditions be invalid, this shall not affect the validity of the other clauses. If a clause of these General Terms and Conditions is invalid in only one part, the other part shall remain valid. The contracting parties shall be obliged to replace an invalid clause by a valid substitute provision which comes as close as possible to the economic purpose of the invalid contractual provision.
